Section 379 in The Indian Penal Code
Section 379 -Punishment for theft.—
Whoever commits theft shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both.
For Example- if a person takes movable property out of another person’s possession without his consent, the person is said to commit the offence of theft and shall be liable for punishment under the Section 379 of Indian Penal Code.
Classifaction of Offence-
> It is a cognizable and non-bailable offence and trial by any Magistrate.
The accused must have a dishonest intention to take the property.To constitute the offence of theft, the following ingredients are required:
The property must be moveable
The property must be taken out of the possession of another person, resulting in wrongful gain by one and wrongful loss to another;
The property must be moved in order to such taking, which results in obtaining property by deception; and
Taking must be without that person’s consent.

भारतीय दंड संहिता की धारा 379 के अनुसार, जो भी व्यक्ति चोरी करने का अपराध करता है उसे किसी एक अवधि के लिए कारावास जिसे 3 वर्ष तक बढ़ाया जा सकता है, या आर्थिक दंड, या दोनों से, दण्डित किया जाएगा।
